These Terms and Conditions of Use (hereinafter, the”Terms and Conditions”) regulate access, content and/or use of the products and services offered through the website https://puntablanca.mx (hereinafter the”Gateway”), made available by La Barcella Consulting Services, S.A. de C.V., a commercial corporation incorporated under the laws of the United Mexican States, located at Santa Fátima 3 Blvd Costa Mujeres, 77400 (hereinafter”Punta Blanca”).

The use of the Portal and/or the services marketed and/or promoted on the Portal gives you the status of user of the Portal (hereinafter, the”User”), and implies full, express and unreserved acceptance of each and every one of the provisions included in these Terms and Conditions from the moment the User accesses the Portal. Consequently, the User must read these Terms and Conditions carefully each time they intend to use the Portal, as they may change from time to time. If the User does not agree with each and every one of the provisions contained in these Terms and Conditions, the User must completely refrain from accessing and/or using the Portal.


By accepting these Terms and Conditions, a contractual relationship is established between You and Punta Blanca. If you do not accept these Terms and Conditions, you will not be able to access the Portal. These Terms and Conditions expressly replace previous agreements or commitments (oral, written or consisting of other types of media, including without limitation, digital media) concluded between the User and Punta Blanca.

Punta Blanca may determine and/or apply, at its sole discretion, supplementary or independent terms and conditions and/or contracts applicable to Punta Blanca services, such as policies for a specific product and/or service, an event, an experience, a shipment, an activity or a particular promotion. These additional or independent terms and conditions and/or contracts will be communicated to you at the time of contracting or acquiring the corresponding Punta Blanca product or service. Supplemental or independent terms and conditions and/or contracts apply in addition to these Terms and Conditions and will be considered part of them for the applicable purposes. The above-mentioned terms and conditions and/or supplementary or independent contracts, duly signed and/or issued by Punta Blanca, will prevail over these Terms and Conditions in the event of a discrepancy between them and the other regarding their subject matter.

Punta Blanca may modify the Terms and Conditions whenever it deems appropriate and at its sole discretion, without any liability. The modifications will be effective after the publication by Punta Blanca of the update of said Terms and Conditions on the Portal and, where appropriate, the supplementary or independent terms and conditions and/or contracts applicable to this Portal. Access or continued use of the Portal and/or the Punta Blanca services or products promoted on the Portal by the User after such publication constitutes acceptance and unconditional attachment by the User to the Terms and Conditions in force at the time of use of the Portal and/or Punta Blanca services or products.

In addition, the User will be subject to any additional terms and conditions that may apply to him when using affiliate services, content published by third parties, or third-party software.

Punta Blanca's collection and use of Users' personal information is carried out in accordance with the provisions of the Punta Blanca Privacy Notice, available at https://puntablanca.mx. Punta Blanca may provide a claims processor, lawyers, external advisors and/or an insurance company with any necessary information (including the User's contact information) if there are complaints, disputes or conflicts, which may include a breach of contract, involving You and a third party and such information or data is necessary to resolve the complaint, dispute or conflict.

Once accessing the Portal, the User will be able to consult information on various consumer goods or services in Punta Blanca (hereinafter referred to as”Product”) in accordance with the purpose and content of the Website.

Access to the Portal https://puntablanca.mx it is completely free of charge. However, the User expressly recognizes and accepts that the Products will be sold under the prices, terms and conditions determined for this purpose by Punta Blanca at its sole discretion.

To access the Portal, the User is responsible for having electronic equipment with an Internet connection and for the associated costs.

Punta Blanca is the sole owner of intellectual property rights, whether registered or unregistered, including: names, logos, images, videos, service marks, domain names, projects, software, texts and data included in the Portal. The User undertakes not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any part of the content or services of the Portal, Products, use of or access to the services.

To access and use the Portal autonomously, the User must be over 18 years of age. Otherwise, you must do so under the supervision and consent of your parents, guardians or legal representatives, as the case may be, who in turn will be solely responsible for the acts performed on the Portal by the minors in your care. They will also be responsible for determining what content and services are suitable for children to access.

Certain Products and/or services available on the Portal may require a registration or subscription. The User acknowledges that, by providing personal information, they grant Punta Blanca the authorization indicated in article 109 of the Federal Copyright Act. If the User decides to register or subscribe to any of these services or related functions, the User undertakes to provide true and accurate information regarding their person, and to promptly update that information if there are any changes. In any case, the User will be solely responsible for any false statements or inaccurate information provided and for any damages, losses, damages and/or liability caused to Punta Blanca and/or third parties for the information they provide.

During the registration process, the User agrees to receive promotional emails from Punta Blanca on a sporadic basis related to the Portal; however, they can later choose to stop receiving such promotional emails by clicking on the corresponding link that will be found at the bottom of any promotional email sent to Punta Blanca.

In cases where the User decides to make use of any service or tool that allows the User to publish any information or content on or through the Portal, the User undertakes and undertakes to use the tools of the Portal in accordance with applicable laws, morals, good customs, public order and the content of these Terms and Conditions. By way of example, but not limited to, the User undertakes to refrain from engaging in any of the following behaviors:

  1. Otherwise, Punta Blanca may immediately suspend the provision of Services to the User.
  2. Impersonating another person or entity, entering false, altered or distorted data causing error, confusion, misunderstanding or deception.
  3. Falsify headers or otherwise manipulate identifiers of Punta Blanca services.
  4. Enter, publish, send emails or otherwise transmit any content that you do not have the right to transmit by legal, contractual or fiduciary provision (privileged information, confidential information, sensitive information, personal data of third parties, among others).
  5. Any action, act or activity that violates copyrights, patents, trademarks, trade secrets, industrial property rights in general, reproduction rights or any other intellectual property right of Punta Blanca and/or any third party.
  6. Introduce, publish, send emails or in any other way transmit any advertising, promotional material, junk mail (Junk Mail), chain letters, scam pyramids, or any other form of solicitation, except in areas of the Portal that may be expressly designated for that purpose.
  7. Introduce, post, email or otherwise transmit any material that contains computer program viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer program or hardware or telecommunications equipment.
  8. Interfering with or interrupting Punta Blanca's services and/or the Products and/or the servers or internal networks connected to the Services.
  9. Violate any applicable laws in the national territory, whether local, state, federal or international.
  10. Any other activity contrary to the law and good morals.

The Portal will have an indefinite duration. However, Punta Blanca may terminate these Terms and Conditions, stop offering, modifying, limiting and/or denying access to any of Punta Blanca's Products and services, unilaterally, at any time and without prior notice.

Punta Blanca does not undertake at any time to warn/inform Users in advance of the modification, cancellation, suspension or termination of their services on the Portal or about the modification or termination of these Terms and Conditions.

Punta Blanca will have the right to modify or discontinue the content of the Portal or any of its services and Products or any part of the latter, temporarily or permanently, at any time.

Punta Blanca will not be responsible to Users or third parties for any modification, suspension, or interruption of the Portal, Punta Blanca services and/or Products. Punta Blanca may withdraw or suspend at any time and without prior notice the provision of Punta Blanca services and/or Products to those Users who fail to comply with the provisions of these Terms and Conditions.

The User accepts that Punta Blanca will not be responsible under any circumstances to the User or to third parties for any termination or limitation of access to the Services.

The data collected by Punta Blanca from the User during the use of the Portal will be treated by Punta Blanca in accordance with the Privacy Notice available at https://puntablanca.mx which is incorporated by reference into these Terms and Conditions. The foregoing, on the understanding that the Portal complies with the Law on the Protection of Personal Data Held by Individuals, Users will have access to the Privacy Notice from the Portal.

The Punta Blanca services and/or Products offered on the Portal are subject to their existence and availability, so the delivery time may vary with prior notice from Punta Blanca. It may even proceed with the cancellation of the order and the return of the charges to the User, if Punta Blanca deems it appropriate at its sole discretion.

If an invoice is required, the User may send an email to request support to: info@puntablanca.mx, providing an image of your consumer ticket.

Invoices must be requested within the same month in which the Product was purchased and/or in which Punta Blanca provided its services to the User. Invoice requests will not be processed after this deadline.

When requesting the invoice, it will be necessary for the User to provide the following tax information to Punta Blanca:

  • Order or service number to be invoiced, specifying the amount and accompanying proof of payment;
  • RFC with homoclave;
  • Full name or company name/reason;
  • Email address where the bill will arrive; and
  • Full address.

Once the corresponding invoice has been issued, Punta Blanca will not be able to re-invoice or issue subsequent invoices for the same expenditure/consumption/service/product.

In the event of a dispute between Punta Blanca and the User, the parties expressly and irrevocably submit to the jurisdiction of the competent courts of Mexico City, as well as to the applicable legislation of Mexico City, expressly waiving any other jurisdiction and/or jurisdiction that may apply to them by reason of their present or future address and/or for any other reason.
